You can escape by either selling your interest in land or filing a partition action.
Trapped owning a property with others? If they are refusing to sell or divide, you have a choice:
- Either file a lawsuit to partition (read: divide) the land fairly (think :acreage such as farm land or forests) or sell in lieu of partition (think: house on 1/4 acre lot — it can’t be divided without causing substantial injury to the value), OR
- SELL your interest to a 3rd party and let them deal with the problem of co-owning.
For the purposes of this site, my company is willing to look at buying your interest. Keep in mind, we’re not going to pay full freight because there’s going to be headaches involved.
